Nevada Supreme Court won’t reconsider Nathan Chasing Horse petition to drop case

LAS VEGAS (KSNV) — The Nevada Supreme Court has rejected Nathan Chasing Horse’s request for another hearing to have the sex abuse case against him dismissed.

Chasing Horse’s attorney, Kristy Holston, filed a petition for a rehearing on Jan. 2, arguing that the court overlooked facts and legal issues when a three-justice panel ruled against him in December.

Holston had argued during a hearing in November that the indictment should be dismissed because of procedural errors in the instructions given to a grand jury and failure to present exculpatory evidence.

Justices Patricia Lee and Ron D. Parraguirre sided against Chasing Horse, writing that “not satisfied that petitioner has demonstrated that entertaining the writ is warranted, and without deciding upon the merits of the claims raised in the petition, we decline to exercise our original jurisdiction.”

Both Lee and Parraguirre ruled against his request for a rehearing in an order filed Tuesday, Jan. 16. They did not give a reason for their decision.

Justice Douglas Herndon, who dissented from the original ruling, also dissented from the order denying Chasing Horse a rehearing. He wrote the court “erred in its decision to not entertain the merits of the writ.”

Chasing Horse is charged with 18 felonies, including sexual assault of a minor, child abuse and kidnapping. He has pleaded not guilty to all counts.

Authorities have accused him of using his position as a self-proclaimed medicine man to lead a cult, gain access to vulnerable Indigenous women and girls, and take underage wives starting in the early 2000s.

The criminal case against him has been on hold pending the appeal. A status check hearing in Clark County District Court is now scheduled for Jan. 24.
