Judge denies Lori Vallow Daybell’s motion to dismiss her Gilbert case

PHOENIX — Lori Vallow Daybell’s efforts to throw out one of her criminal cases in Arizona did not work.
New records obtained by 12News show show that a judge recently denied her motion to dismiss one her cases in Maricopa County.
Vallow Daybell was convicted in Idaho in 2023 for killing her children, Tylee and JJ, who used to live in the Valley.
She was sentenced to life in prison in Idaho in that case. Her current husband, Chad Daybell, was sentenced to death in Idaho for the same case.
A few months after her sentencing in Idaho, Vallow was extradited to Arizona to face two counts of conspiracy to commit first-degree murder. One case is out of Chandler in the July 2019 death of her former husband, Charles Vallow.
The other case is out of Gilbert involving an October 2019 shooting attempt at the ex-husband of Lori Vallow’s niece’s. He was ultimately not injured.
Each case will have its own trial.
Earlier this month, she filed to dismiss that second case out of Gilbert, claiming her right to a speedy trial was violated.
Court records now show the judge rejected that argument and said the trials could happen back-to-back. He noted that the cases experienced delays under “extraordinary circumstances,” in part, due to the complexity of the cases and high volume of discovery.
In December, the judge approved Lori Vallow Daybell’s request to represent herself. The motion to dismiss is part of a series of motions she’s submitted to the court since she started going pro se.
Jury selection for the first trial for the case out of Chandler is scheduled to start in March.
