Judge Quashes Summons in Woman’s Suit vs. Scientology Church Leader

Church of Scientology International leader David Miscavige won a round in court when a judge ruled he was not properly served with a lawsuit filed by a self-professed former friend of the late Lisa Marie Presley, who alleges she was forced into marriage as a minor and sexually abused by her then-husband before and after they were wed.
Thursday’s ruling by Los Angeles Superior Court Judge Robert B. Broadbelt means that attorneys for plaintiff Jane Doe will have to try again to perform service on Miscavige, a co-defendant in the suit along with the church and its Religious Technology Center, which was founded in 1982 by the church to control and oversee the use of all of Scientology trademarks and symbols as well as Scientology and Dianetics texts.
“The court finds that plaintiff has not met her burden of proving the facts requisite to effective service,” the judge wrote, saying Doe’s attorneys had not provided evidence to show that either of the locations they listed on Sunset Boulevard and Franklin Avenue were indeed Miscavige’s usual place of business where service could be performed by leaving the papers with security guards.
